The Peruvian Congress has officially enacted Law No. 32159, a landmark regulation aimed at controlling the consumption of tobacco products, nicotine, and their alternatives. This comprehensive measure, which marks the country’s first legislation explicitly regulating electronic cigarettes, represents a significant step in Peru’s commitment to public health.
The law seeks to “protect the health of individuals from the consequences of consuming tobacco, nicotine, and their substitutes, as well as exposure to tobacco smoke and emissions from electronic cigarettes with or without nicotine.” It introduces strict limitations on smoking and vaping in both private and public spaces while extending its scope to heated tobacco products.
Key Provisions of Law No. 32159:
- Smoke-Free and Vape-Free Zones:
- Smoking or vaping is now prohibited in healthcare facilities, educational institutions, government offices, workplaces, enclosed public spaces, and all modes of transportation. These locations are officially designated as 100% smoke-free environments.
- Ban on Advertising, Promotion, and Sponsorship:
- The law bans all forms of direct and indirect advertising and promotion of tobacco products, including cross-border campaigns. This extends to the sponsorship of events or activities by tobacco or vaping-related brands.
- Strengthened Public Health Protections:
- The legislation is designed to reduce exposure to secondhand smoke and electronic emissions, protecting individuals in both private and shared environments.
The enactment of this law is a clear signal of Peru’s alignment with global public health efforts to reduce the harm caused by tobacco and nicotine consumption. By prioritizing smoke-free and vape-free environments, the country is taking a proactive stance in safeguarding its citizens’ health.
About the Legislation:
