Manila, Philippines— In a decisive move to safeguard the youth and prioritize public health, Department of Trade and Industry (DTI) Secretary Fred Pascual signed the Department Administrative Order (DAO) No. 24-03, series of 2024, on July 20. This order mandates the immediate suspension of online sales of vapor products, vapor product devices, and vapor product systems on marketplaces.
The directive emerged from the “Kapihan” dialogues, a series of high-level discussions initiated by the DTI with key stakeholders in the vape industry, including manufacturers, importers, and distributors. Secretary Pascual emphasized the critical need for comprehensive regulatory measures, citing three main areas of focus:
- Robust Tracking Systems: Implementing mechanisms to oversee the movement of products from importers to retailers.
- Accountability: Holding manufacturers and importers responsible for illegal or defective products, extending liability beyond just the retailers.
- Distributor Education: Ensuring that distributors educate retailers on legal limitations and restrictions to ensure compliance.
Secretary Pascual acknowledged the concerns raised by manufacturers about unused inventory, noting that some had already ceased ordering 90-day stock since the transitory period began. Despite the DTI’s preference to avoid imposing new regulations, the Secretary stressed that non-compliance would result in severe consequences.
“The protection of our youth is non-negotiable. The proliferation of vapor products on online marketplaces has made these harmful substances easily accessible to minors, posing a significant threat to their health and well-being. This suspension is a necessary step to curb this alarming trend,” Secretary Pascual stated.
The DTI’s decision is grounded in the provisions of Republic Act (RA) No. 11900, known as the Vaporized Nicotine and Non-Nicotine Products Regulation Act. This law enforces measures to prevent minors from accessing vapor products, particularly through online channels. The suspension aligns with the government’s broader commitment to fostering a healthy environment and shielding citizens from the potential hazards associated with these products.
“We want businesses to thrive, but it must be in line with the law,” Secretary Pascual asserted. “Let’s not profit from selling to minors. As long as you comply, we will support you. However, you must prove that you are preventing minors from buying these illegal products.”
The DTI will continue collaborating with relevant agencies to monitor the vape industry and implement stringent measures ensuring compliance with RA 11900. The DTI’s Task Force Kalasag has already made significant progress in regulating the industry, issuing 78 notices of violation and confiscating 64,359 violative vape products, valued at PHP 29,487,100.00, since its formation in April.
